GENERAL INFORMATION
These General Terms and Conditions of Sale govern the purchase of products made remotely via the internet on the website donnaeco.it, owned by Giuma s.r.l.s. – Registered Office: Via Cicori, 18 – 80010 Quarto (NA). Every purchase transaction will be regulated by the provisions of Legislative Decree 185/99, Legislative Decree 206/05; information directed to the conclusion of the contract will be subject to art. 12 of Legislative Decree 70/03 and, as regards the protection of confidentiality, will be subject to the regulations of Legislative Decree 196/03.
CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE
Sales contracts for products on the donnaeco.it website are considered concluded when the purchase order placed by the customer is received by Donna Eco’ and the latter accepts it. Donna Eco’ will promptly send the customer a receipt of the purchase order placed by the customer.
By electronically submitting their purchase order, the customer declares to have read and accepted these general contractual conditions and undertakes to observe and respect them in their dealings with Donna Eco’.
PROCESSING OF PERSONAL DATA
Donna Eco’ pursuant to art. 13 of Legislative Decree 196/2003 informs that personal, biographical, and fiscal data acquired, including verbally, in reference to established commercial relationships, provided directly by the interested parties, or otherwise acquired within the scope of Donna Eco's activities, will be processed in compliance with the aforementioned regulations, including the confidentiality obligations stipulated therein. In relation to the foregoing, the rights under article 7 of Legislative Decree 196/2003 may be exercised.
CUSTOMER OBLIGATIONS
The Customer is required, before placing their purchase order, to carefully read these general terms and conditions of sale. The submission of the purchase order implies their full knowledge and acceptance.
Finally, once the online purchase procedure is completed, the Customer is required to print and keep these general terms and conditions of sale, which have already been viewed and accepted during the contract conclusion phase.
ORDER DEFINITION
By submitting the online order, the Customer sends Donna Eco’ a proposal to purchase the product and/or products placed in the cart. When the Customer places an online order for the products they have placed in the cart, they agree to purchase them at the price and terms indicated in these General Terms and Conditions of Sale. Donna Eco’ will communicate to the Customer the acceptance and confirmation of the order. In particular, Donna Eco’ will not accept orders: if the material is not available in stock at the time of the order and/or if the Customer cannot or does not want to pay using credit cards, bank transfer, or PayPal.
PURCHASE METHODS
The customer purchases the product, whose characteristics are illustrated online in the relevant descriptive and technical sheets, at the price indicated therein, plus delivery costs as specified on the website. Before submitting the purchase order, the unit cost of each selected product, the total cost in case of purchasing multiple products, and the relative delivery costs are summarized. Once the purchase order has been submitted, the customer will receive an email from Donna Eco’ confirming receipt of the purchase order and containing information regarding the main characteristics of the purchased item, a detailed indication of the price, delivery costs, applicable taxes, and payment methods, and containing a reference to the general terms and conditions of the contract and information about the existence of the right of withdrawal, the conditions and methods of its exercise displayed on the website. Following the approval of Decree Law 4 July 2006 no. 223 "manovra bis" Art. 37 paragraphs 8 and 9, converted into Law 248 of 4 August 2006, which came into force on 12 August 2006, which reinstated the obligation to communicate the list of customers and suppliers in the case of invoice issuance, and Decree Law 78 of 31 May 2010 converted into Law 122 of 30 July 2010, it is necessary to ask customers to communicate their VAT number and tax code in the appropriate fields on the website.
PAYMENT
The customer can make the due payment by choosing one of the following methods listed.
Payment by credit card: If the consumer intends to make the payment by credit card, they can use the PayPal payment procedure, suitable for ensuring the confidentiality of the data provided by customers. For all information and further Legal Agreements, the Customer is referred to the website www.paypal.com.
If payment is made by bank transfer, the purchased goods will be shipped according to the methods described in the following paragraph "Delivery of Products", to the address indicated by the customer upon receipt of the credit, therefore, on average, within two/five days after the bank transfer is made (timings vary depending on the Credit Institution used).
DELIVERY OF PRODUCTS
The purchased item, together with the relative invoice, is delivered via courier to the address specified by the Customer at the time of the online order. Any specific needs must be communicated by the customer to Donna Eco’.
Donna Eco’ guarantees delivery of the goods within 15 (fifteen) working days from the date of receipt of the transaction confirmation. (For cash on delivery payment, the 15 days will be counted from the date of receipt of the order via email.). In the event that the customer chooses the cash on delivery method, payment must be made exclusively in cash or by cashier's check, to be handed directly to the courier upon receipt of the goods. In case of non-delivery due to the absence of the recipient at the address indicated in the order, the courier will leave a notice and try again a second time; if the recipient is still absent, the goods will be returned to the sender.
WARRANTY OF CONFORMITY AND DEFECTIVE PRODUCTS
Products purchased on donnaeco.it are subject to consumer goods sales regulations. The delivered products conform to the characteristics illustrated online in their respective descriptive and technical data sheets.
Donna Eco’ is responsible to the customer for any defects in conformity existing at the time of delivery of the goods.
If the goods have been delivered, the customer is required to return them to Donna Eco’ within 15 (fifteen) working days from the date of delivery of the goods. The goods must be returned to Giaccio complete with all accessories, instruction manuals, and everything originally delivered to the customer, as well as packaged in their original packaging. A copy of the electronic order receipt must be attached to the returned product. The costs of returning the goods to Donna Eco’ are borne by the customer. If the right of withdrawal is exercised by the customer in accordance with the provisions contained in this clause, Donna Eco’ is obliged to refund the sums paid by the customer. In particular, Donnaecò64 will, free of charge, process the re-credit order relating to the cost of the shipped goods including shipping costs within 30 (thirty) days from the date on which it became aware of the exercise of the right of withdrawal by the customer. This operation will be carried out via the credit institution that issued the credit card used for payment or by crediting the sum to the bank account indicated by the customer. Donnaecò64 has the right to reject any product returned in a manner other than those specified above, as well as products for which the return costs have not been fully paid by the customer, or for which the methods and times indicated for communicating the exercise of the right of withdrawal have not been respected.
COMPLAINTS
For any complaints or clarifications, the customer should contact info@donnaeco.it. The customer will be contacted for clarification within 3 (three) working days of the request.
APPLICABLE LAW AND JURISDICTION
This contract is governed by Italian law. The jurisdiction and exclusive forum for any legal action brought by the Buyer under this warranty or any further legal warranties will be the Court of Naples. In the event of Donna Eco’ winning any legal action, the plaintiff shall reimburse Donna Eco’ for the costs, including attorneys' fees and litigation expenses, incurred by Donna Eco’ for its defense.
REFERRAL
For anything not expressly provided for in this contract, the provisions of current Italian law apply.
